Consequences

Some of consequences of what occurs to rape victims and or bystanders are great. You see, the victim often feels a sense of fault for what occurs and often times has feelings of depression. The victim often feels alienated and looked down upon. The bystander often feels guilt of allowing the act to occur without stepping in.

Health care personnel are allowed to give rape kits to anyone who feels they have or could have been raped.

In order to encourage victims to report these crimes and to seek treatment and
counseling, the Commonwealth of Pennsylvania must implement changes in community
education and encourage the development of sexual assault response teams (SARTs).
Members of a team would include, at a minimum, a medical director, a sexual assault
forensic examiner (SAFE), a sexual assault counselor/advocate, a law enforcement
representative and a Commonwealth’s attorney.

Police investigate rape and sexual encounter

Police investigate rape by asking the possible raper questions.


Police say the sexual encounters were videotaped without the knowledge of the participants, according to an affidavit of probable cause filed.

Laws involving videotaping individuals without their knowledge can differ based on a number of circumstances that may be involved in a particular instance.



According to Cumberland District Attorney David Freed, a major distinction between what is considered a felony and what is considered a misdemeanor is whether or not the footage contains sound.



“The distinction is made with the interception of oral communication and video,” Freed said. “If it does contain sound, it is a wire tap violation, and that is considered a felony of the third degree. If it is just video, it is considered a third-degree misdemeanor if there is only one violation or a second-degree misdemeanor if there is more than one, and there’s usually more than one.”



Second-degree misdemeanors have a maximum sentence of two years for each violation.



Among violations involving only video, there is also another distinction between filming a public act and a private act.



If a person is filmed walking down the street, there is no violation, according to Freed. That, however, does not include “upskirting,” where people film underneath the skirts of women walking in a public area.



“It was sort of a new thing, and there wasn’t a law for it before,” Freed said. “There was a case in Cumberland County that changed that law in 2005, to take effect in January 2006. There was a man who was filming women at the Capital City Mall, but the charges were dropped, and the woman wasn’t happy with that result. We got that law changed.”



The law now includes a section prohibiting the videotaping of intimate body parts, even if they are covered.



For violations involving a private area, such as a home, it is not illegal to own security cameras or to tape those visiting the household without notifying them of the cameras.



What does make the security camera footage illegal is when what is being filmed is sexual in nature, according to Freed.



The Invasion of Privacy law states that a person commits an offense when filming someone without his/her knowledge and using the videotapes or photography for sexual gratification, recording a person in full or partial nudity or filming someone who has a reasonable expectation of privacy. Taping sexual acts without consent would also fall into this category as a violation of privacy.

A rape kit

A rape kit is all the tools necessary to determine if you were or have been raped. They are also known as the "Jane Doe rape kits". These are private.

A sexual assault evidence collection kit, sexual assault forensic evidence (SAFE) kit or Sexual Offense Evidence Collection (SOEC) kit in New York[1] is a set of items used by medical personnel for gathering and preserving physical evidence following a sexual assault which can be used in criminal proceedings. The kit was developed by Louis R. Vitullo and was for years referred to as the Vitullo kit.

The term applies also to the collected evidence for a specific case.

In the United States, as of 2009 states will have to pay for "Jane Doe rape kits," also known as anonymous rape tests, in order to continue to receive funding under the U.S. Violence Against Women Act.[2]

It is a private non-profit agency. The RCIS is free to victims of rape, sexual abuse, and all other forms of violence- domestic etc.. It has been in Carroll County since 1978. They also offer educational and professional training programs about sexual violence and advocacy. They can be reached by phone, fax or e-mail , all of this is anonymous. The line is open 24 hours a day.

This story is completely fake....
Meg: Hey, Tricia are you going to that party on Zoo loom Avenue at 7pm tonight?
Tricia: Yeah, I am.... I heard that guy Matt was going to be there.
Meg: Awesome, he is so dreamy...
Tricia: I know tell me about it.
Meg: Okay well, I'll see you then.
Tricia: Okay, bye Meg.
Meg: Bye
( Later that night, it turns to 7pm but the girls want to be fashionably late so they decide to arrive at 8pm.The party is booming and of course her friend John is there and Matt the guy her and Tricia were talking about were there too!The alcohol has gone straight to Meg's head because as her friends like to call her... she's a lightweight.)

Tricia: Meg are you okay, I mean I am probably wasted right now but... seriously are you okay.
Meg: Sure, why would I not be... I mean I only drank three rum and cokes and a apple martini.
Tricia: okay... I guess...

Now it is going onto 11pm and Meg has to really go to the bathroom and Tricia is no where to be found probably hooking up with her friend Mark. John sees that Meg is alone and decides to take advantage of this opportunity.

John: Do you need help with anything Meg?
Meg: Ah, no I mean I really have to go to the bathroom.
John: I can take you there I would really enjoy that...

(John is totally wasted to because he arrived to the party earlier, it was at 7:30pm when he had arrived he finished off a 36 pack of beer and decided to drink a handle of vodka to prove he was man enough to do this.)

Meg: Okay I guess..
John: Let's go upstairs.... _he tries to kiss Meg- she refuses him... John gets mad and continues anyway to force himself on Meg.
Meg: Stop, I really don't feel good and I really have to go to the bathroom
John backs off...
Meg goes to the bathroom but then when she comes out he( John) pushes her back into the bathroom and forces himself back on her but this time with much more force.

Meg is still screaming for him to get off of her but no one can hear her because the music is still blasting downstairs.

Finally, Meg gets tired and passes out from the pain... John continues to have his way with her even though she is no longer conscious and then when he is done.. he puts back on his pants and shirt walks downstairs to the party and asks for a ride home.

The next day Meg wakes up sore and she can't figure out why, she only remembers telling John No and for him to stop... She goes to the Wellness center to ask for a Rape test kit... she discovers she had been raped but she is too ashamed to tell anyone so she remains silent and besides that she can't remember who it was she was with the previous night anyway.

Bystanders

Bystanders are people who let their friends get abused or victimized. They stand there directly for the fear of being hurt or abused themselves. They believe that it is someone else who the business belongs to. Bystanders just don't get involved because of the fear involved.

The passage of being a bystander
On the phone:
Mike: Hey, can I come over and watch a movie today?
Kristin: Sure, um... My sister and I are home alone right now though.
Mike: That's okay, I'll ride my bike over and see you at your house in about 15 minutes.
Kristin: "Okay that sounds great.
off the phone:
Kristin:Hey, Kim, I just got off the phone with Mike and he's coming over to the house.
Kim: okay Kristin. I'm watching television do you want me to go to my room?
Kristin: No, it's okay you can stay in the playroom.
15 minutes later the doorbell rings...
Kim : Oh, Hi Mike, would you like something to drink.
Mike:No I just want to see your sister where is she?
Kim: Oh, She's in the basement.
Mike: Great!
Kristin: Hi, Mike what movie would you like to watch?
Mike: I don't know, Austin Powers Gold-member.
Kristin: Interesting choice, how come?
Mike: Because I want to play the guy that gets all the ladies. Speaking of ladies, you look really nice right now.
Kristin: Um.. Thanks..
Mike: No problem, dude I am totally in the mood for some fun.
Kristin: What type of fun?
Mike: Pull your pants down to find out.
Kristin: I don't think that's a good idea I mean my sister is upstairs and um.. my parents should be home any minute.
Mike: Well, do it for me anyway please!
Kristin: No mike!
Mike :Okay, okay let's just put the movie in!
Kristin: Great movie choice, oh, foxy lady.
(About a half hour later the two were cuddling)
Mike: Let's try it again please!
Kristin: NO, Kim help me, Mike is like laying on top of me and I don't know what to do! Kim Hurry up, where are you.
Mike: Do you like this better, I mean you said no but I'm going to keep pumping myself into you whether you want me to or not. Who was the last guy you were with?( Kristin screaming in the background now telling Mike to get off of her.) Was the last guy bigger than me? I mean you keep screaming, freaking just stop screaming before i slap you across the face!
Kristin: I think you should leave now. I don't know where my sister is but I hear a car and I think it may be my parents.
The car door slams and scares Mike so he says to Kristin, " Well we will finish this later." If you say a single word of this to anybody I will make your life a living HELL!!!"

Mom and Dad enter the house it's now been an hour and Kim is still in her room.
Kristin goes upstairs after Mike left terrified that something horrible is going to happen.
Kristin goes and knocks on Kim's door and calmly says did you hear me yelling?
Kim: Yeah, I heard you
Kristin: then why did you not come down and tell him to get off me?
Kim: I dunno I mean how do you know he would not have attacked me too and besides it was really none of my business what the two of you do together, I mean you always tell me to get my own life so I was just merely doing what you asked me to do. You also told me to not bother you when you had friends or guests over.
Kristin: I really could have used your help this time though.
